German Regulator Sanctions Ethena, Impacting ENA Token Issuer

The German Federal Financial Supervisory Authority (BaFin) has imposed enforcement measures against Ethena GmbH, the issuer of the ENA token. Citing serious deficiencies in the approval process for its USDe token, BaFin banned Ethena from offering further USDe tokens and directed the company to freeze its corresponding asset reserves through a designated custodian. A special officer has been appointed to ensure compliance with these measures. Additionally, the regulator expressed concerns that Ethena might be selling securities in Germany without the mandated prospectus under MiCAR regulation. In response, Ethena Labs clarified that the sanctions will not affect the listing, minting, or redemption of USDe tokens provided by Ethena BVI Limited, emphasizing that USDe remains fully backed. The company also announced plans to review its terms and conditions in the coming week. This action by BaFin forms part of a broader international trend of heightened regulatory scrutiny over crypto firms, with related crackdowns occurring in other jurisdictions such as South Korea.
